2. Service Description
PicPlate offers:
- AI-powered food recognition from photos
- Nutritional estimation and meal tracking
- Apple Health integration (optional)
3. Disclaimers
3.1 Not a Medical Device ⚠️
PicPlate is NOT intended for diagnosing or treating diseases. Consult a doctor or nutritionist for health-related questions.
3.2 AI Accuracy ⚠️
The AI may misidentify foods or inaccurately estimate portions. Verify results yourself, especially for allergies or medical restrictions.
3.3 Allergies ⚠️
PicPlate does NOT reliably detect allergens. Never rely solely on the app.
4. Limitation of Liability
We are fully liable for intent, gross negligence, and damages to life, body, or health, as well as under Product Liability Law.
For slight negligence, we are only liable for breach of essential contractual obligations, limited to foreseeable, contract-typical damages.
Otherwise, liability is excluded to the extent legally permissible.
We are NOT liable for:
- Inaccurate AI estimates
- Health problems from relying on app data
- Allergic reactions
- Data loss
5. User Obligations
You agree to:
- Be at least 16 years old (or have parental consent)
- Not use the app for medical diagnoses
- Critically verify AI results
- Consult a doctor for medical conditions (e.g., diabetes, eating disorders)
- Read ingredient labels on packaging yourself if you have allergies
- Not misuse the app
6. Data Protection
See Privacy Policy for details. All meal data remains local on your device.
7. Termination
You can terminate use anytime by uninstalling the app.
8. Applicable Law
German law applies. Place of jurisdiction is Hamburg.
9. Changes to These Terms
We may update these Terms at any time. For material changes, we will notify you via in-app notification. Continued use after changes constitutes acceptance.
10. Severability
If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full effect.
